How to Register a Trademark & Copyright with IPO Pakistan (Brand Protection Blueprint)

Why Intellectual Property Protection is Non-Negotiable

In Pakistan's rapidly expanding digital economy, brand equity is often a company's most valuable asset.

If you do not legally register your trademark with the Intellectual Property Organization of Pakistan (IPO-Pakistan), anyone—including a competitor, an ex-employee, or a distributor—can register your brand name and legally force you to rebrand, shut down your social media handles, or seize your inventory through civil court injunctions.

The 5 Stages of Trademark Registration with IPO Pakistan

Stage 1: Preliminary Search (Form TM-55)

Before submitting a formal application, conduct a search across the relevant NICE Class to identify:

• Identical word marks.
• Phonetically similar marks (e.g., "Kool" vs. "Cool").
• Visually confusing logos.

Stage 2: Application Submission (Form TM-1)

Submit Form TM-1 along with:

• The exact mark representation (Word mark, Logo, or Combined).
• Specification of goods or services according to NICE Classification.
• User clause declaration: Whether the mark is currently in use in Pakistan (with documentary proof like invoices) or proposed to be used.
• Official application fee (Rs. 3,000 per class).

Stage 3: Examination & Show-Cause Hearing

The Trademark Registry examines the application for:

• Absolute Grounds for Refusal (Section 14): Is the mark merely descriptive (e.g. trying to trademark "Fresh Mango" for mangoes)?
• Relative Grounds for Refusal (Section 17): Does it conflict with an earlier registered mark?
• If objections arise, an Examination Report is issued, requiring a written reply or attendance at a formal hearing before the Assistant Registrar.

Stage 4: Publication in the Trade Marks Journal

Once accepted by the Registrar, the mark is published in the official monthly Trade Marks Journal. The public has 60 days to file an opposition (Form TM-5).

Stage 5: Registration Certificate (Form TM-11)

If no opposition is filed (or if an opposition is decided in your favor), the applicant pays the final registration fee (Rs. 9,000) and receives the official Registration Certificate, allowing the use of the registered symbol ®.
